A man in his 30s has been sentenced to six months in prison for negligent homicide after he drove into a stationary car at 100 kilometers per hour on the E6.

On 3 January 2020, there was a queue north of the Follotunnelen on the E6 in the direction of Oslo after a traffic accident.

A man in his 30s who came driving in a Land Rover did not see the queue, and drove into the back car in the queue at 100 kilometers per hour, about 800 meters from the tunnel exit.

In the car he drove into sat a married couple. The man in the couple died three days later from the injuries he sustained in the collision, while his wife was paralyzed from the chest down.

In December last year, the man who drove the Land Rover was sentenced to 120 days in prison, but the prosecution appealed. The Borgarting Court of Appeal has now increased the sentence to six months in prison.

In the Court of Appeal, the man claimed that he fiddled with the car radio before the collision.

However, the investigation has shown that he sent a text message on his mobile phone five seconds before the collision, and the court believes that the man wrote the message immediately before it was sent.

The court points out that the man had a clear view for about 800 meters from the tunnel exit, and that at a speed of 100 kilometers per hour he had 25 seconds to register that the cars were stationary until he was 100 meters from them.

– When the attention is then so much directed at the telephone, it means in the view of the Court of Appeal that the accused has shown gross negligence over some time, it is stated in the judgment.
