The Supreme Court of the united States blocked the execution of Ruben Gutierrez, about an hour before his scheduled execution, as reported by the news agency The Associated Press.
The lawyers of Gutierrez had argued that they were in violation of their religious rights, because the prison system did not allow a chaplain to accompany him to the chamber of death.
Last year, the prison system of Texas forbade the clergy from the house of the death after a Supreme Court ruling that halted the execution of another inmate, Patrick Murphy, who had requested to be allowed to the input of an advisor to a buddhist.
In response to the ruling in the Murphy case, the prison system in Texas changed its policy to allow no more the clergy in the chamber of death, and that only the security staff of the prison could enter the execution chamber.
“Through hundreds of earlier executions, the state of Texas has recognized that the executed people have a right to be in the presence of counselors religious when facing the end of their lives,” said Shawn Nolan, one of the attorneys for Ruben Gutierrez.
“Mr. Gutierrez has that same right,” the lawyer said.
The Supreme Court said that granted a suspension pending a decision of the superior court, on the petition of Gutierrez about allowing a spiritual advisor to accompany you to the chamber of death.
A decision was expected on the petition at a later date.
Prosecutors said that Gutierrez, 43, was trying to steal more than 600 thousand dollars that mrs. Escolastica Harrison had tucked away in his home in Brownsville, located at the southern tip of Texas, when he killed her in 1998.
If you carry out the execution of Gutiérrez, it would be the first inmate in Texas to receive a lethal injection from the six February and the second inmate american to be executed since the country began to reopen after a pandemic shut down much of the U.S.
The country began to reopen, Missouri resumed executions in the united States on may 19.
Six executions scheduled in Texas for early this year were postponed by a court of appeals or judges due to the outbreak.
A seventh run was delayed by claims of intellectual disability.
The lawyers of Gutierrez also sought a delay related to the coronavirus, but were rejected on Friday by the Court of Criminal Appeals of Texas.
