People and companies are demanding damages for 57.6 million crowns and lost profits for 227.3 million crowns. The maximum amount requested from one natural or legal person is over 108 million. Claims under the Crisis Act can be asserted within six months of the person becoming aware of the damage.

“In the case of a claim for compensation for lost profits, it can be stated that such a claim cannot be reparated according to the Crisis Act, while the applicant can be referred to the relevant compensation programs approved by the government,” said Malá. According to her, the state is liable for damage under the Crisis Act only if it was caused by the intervention of the crisis authorities. According to the spokesperson, none of the assessed applications has been substantiated so far, so the interior has not yet reimbursed any of the requested amounts.

At the beginning of the month, the iRozhlas server stated that a group of about 500 entrepreneurs from various fields are preparing a mass application for compensation. They turned to lawyer Daniel Zinrák, who specializes in damages. Zinrák will first check which of the entrepreneurs meet the criteria for submitting an application. According to the lawyer, applicants can mainly claim fixed costs, such as rents, equipment leases or permanent energy payments.

Lawyers have differing views on the extent to which people and businesses are entitled to compensation for coronavirus measures. For example, the Minister of Justice Marie Benešová (for YES) told Czech Television at the beginning of May that the state had not caused damage by measures against the spread of coronavirus. It therefore does not anticipate that any actions for damages could succeed.
