The Court of Instruction number two of Santa Cruz de Tenerife, in the functions of the guard today, Wednesday, has been seen this morning in rapid judgments under two cases of people who jumped without justification the containment measures imposed by the Government of Spain to prevent the spread of the coronavirus. Both processes have ended in convictions with penalties of fine, to which is added the penalty arising from the administrative record filed by the National Police.
In the first case, police officers made available to court a person who on Tuesday was intercepted in the roadway when he was wandering aimlessly apparent and does not give any explanations about if you jumped the confinement to meet with some of the assumptions provided for by law or was illegal.
This person is not only unable to explain the why of their presence on the street, but who refused to identify themselves to the agents and joined with them in a discussion growing which ended in aggression on the part of the passer-by, the police.
Before the judicial authority, the person admitted the facts and his guilt and was sentenced to a sentence mitigated by his confession to four months of a fine with a fee of three euros a day as the author of a crime of disobedience and resistance to authority-a total of 360 € to 20 days of fine with a daily fee of 3 euros (a total of € 120) for each of the two offences of minor injury accomplished by assaulting law-enforcement officers.
In addition to these convictions, the offending person shall indemnify to the two policemen in the sum to be determined in the process of execution of a sentence. These sentences are independent of the administrative sanction that shall be imposed when it is processed the complaint issued by the Police.
The second case that saw the court today on breach of the confinement refers to a case recorded this same Wednesday, in which the person refused to identify himself and resisted the authority, while it did not threaten the agents. Was formed with the conviction, attenuated to their acquiescence: four-month penalty with a fee of three euros a day as the author of a crime of disobedience and resistance to authority-a total of 360 euros-. As in the other case, this sentence is independent of the sanction in the administrative procedure.
