It is a pioneering judgment: Cities can in principle impose driving bans on dirty diesel to make the air cleaner, judges the Federal Administrative Court. But it emphasizes the principle of proportionality.

Es is a pioneering judgment: cities have the right to impose driving bans on diesel cars for air pollution control. The Federal Administrative Court decided that. The defendant cities of Düsseldorf and Stuttgart would have to check their air quality plans for proportionality, the verdict was.

In the last instance, the judges in Leipzig had to check whether such bans are permissible in the fight against nitrogen oxide pollution in the air – even without a nationwide uniform regulation.

It is solely up to the individual cities and district governments whether there are driving bans – there is no automatism. It could take weeks or months from city to city before driving bans are actually included in the so-called air pollution control plans.

For many years, pollutant limit values have not been observed in many cities. It is about nitrogen oxides that are considered harmful to health. According to the Federal Environment Agency, the transport sector, especially diesel cars, contributes around 60 percent of the burden.

The Federal Environment Agency collects and evaluates the data from over 500 measuring stations across Germany. Not all stations work fully automatically. The manually determined values are not yet available for 2017.
