Starting today, when a realtor enters into a house sale contract, it is necessary to confirm with the seller whether the tenant has exercised the right to apply for renewal of the contract and write it in the contract.
The Ministry of Land, Infrastructure and Transport announced that the Enforcement Rule of the Certified Brokerage Act, which requires tenants to stipulate whether or not to exercise their right to request renewal, in the instructions for confirming brokerage objects, will be implemented from today.
Since last year’s lease law was revised, it is not clear whether or not the tenant exercised the right to renew in the purchase and sale of a house where the tenant is located.
Accordingly, in the future, when brokering home sales, the realtor must check whether the tenant has exercised the right to apply for contract renewal from the seller, and write this in the instructions for confirming the target of the broker.
In addition, the seller also required documents stating whether the tenant exercised, planned to, or refused to exercise the right to apply for contract renewal.
