The lawyer Vittorio Fuck itdefender of the largest number of civil parties in the trial relating to Nicola’s murder Zeppetelliexpresses full satisfaction with the confirmation of the sentences to Sweater and Moscatiello on the part of the Court of Appeal of Assizes. The sentence accepted the requests of the civil parties advanced during the discussion and with the reply submitted subsequently, rejecting the defendants’ requests for acquittal: “I learn with full satisfaction the sentence of the Court of Appeal of Assizes in full acceptance of the requests of the civil parties, advanced both during the discussion and with the reply brief that I presented following the discussion of the defenders of the defendants. The Court decided to reject the requests of the defendants’ defense with which they asked for acquittal for Maglione for the crime of voluntary homicide with reduction to a lighter crime and for Moscatiello total acquittal. The responsibility of Alessio Maglione as the material executor of the voluntary homicide and the responsibility of Moscatiello as a participant in the homicide were therefore definitively recognized in the degrees of merit. Taking into account the fact that Moscatiello did not shoot himself, and is accused of complicity, the sentence is largely satisfactory and I consider the residual and minimal reduction of the sentence from 12 years to 10 years and 8 months of imprisonment totally irrelevant, which does not changes absolutely nothing neither from the point of view of the extent of the punishment, nor of full responsibility in the fact that it has been widely recognized by the sentences of first and second degree of judgement”concludes the note.
