Their house was broken into in July 2019, in the middle of the summer night. The family was asleep when the intruders entered through a window on the first floor before stealing the computer, telephone, car key… Since then, the father has blocked the access doors with props. He came to entrust this detail to the Thionville criminal court on Tuesday. He also evokes sleepless nights and the difficulty of quantifying such trauma.

Two young boys, born in 2000, have just been convicted of burglary, attempted theft, concealment committed in Yutz between May and July 2019. They were not present at the hearing, they did not face the distress of the only victim present.

Judicial information

The geolocation of a stolen phone notably made it possible to trace the trace of one of the defendants. DNA analyzes, hearings of witnesses, CCTV images fueled the detailed investigation, opened as part of a judicial investigation, supervised by an investigating judge. Two minors, alleged accomplices, are also referred to the juvenile court.

The file identifies a theft of a scooter and several vehicles. The thefts of a game console, a luxury watch, a drinks machine add to the list of misdeeds. A complainant even says that her home being repaired was occupied, degraded, soiled. Burglars broke into the cellar, climbed a scaffolding or took advantage of a partially open roof window to break into the apartments. Some victims, roused from their sleep by the noise, managed to put them to flight.

Damage to be quantified

“Nobody disputes the detestable nature of this file,” begins the defense. The lawyer for the main defendant, prosecuted for fourteen offenses, portrays an immature kid, who has not realized the seriousness of such acts. Me Amadori recalls that his client, already convicted of drug or violence cases in the past, spent time in prison. And the experience would have changed him. “He is undergoing training to become a driving school instructor, his uncle extended his hand to him”, reports the lawyer.

The court sentences Younès Saoudaoui to one year in prison, which can be arranged by the judge responsible for the execution of sentences. His sidekick, less involved, less known to justice too, receives eight months in prison, four of which are suspended. Compensation for victims will be discussed at a civil hearing next January.
