Democratic Party Politicians Andi Arief say Yusril Ihza Mahendra is building a fiction against the Decree of the Minister of Law and Human Rights related to several articles of the Democratic AD/ART. Andi also called Yusril inconsistent.
Yusril, who is also the general chairman of the Crescent Star Party (PBB), became the attorney for four former cadres of Moeldoko’s Democratic Party. Yusril accompanied four cadres to sue the Democratic AD/ART to the Supreme Court.
“Not a legal breakthrough, but Prof @Yusrilihza_Mhd is building a fiction against the Menkumham Decree regarding several articles of AD/ART that have been officially ratified by the state. In the near future the Democratic Party legal team will answer and be ready to face it,” Andi said via Twitter account, @Andiarief_ , quoted CNNINdonesia.com, Friday (24/9).
Andi has allowed his statement to be quoted and stated, “Yusril is inconsistent.”
Yusril previously mentioned the institution authorized to examine the party’s AD/ART. He said that his attempt to examine the formal and material AD/ART of political parties to the Supreme Court was a new thing in Indonesian law.
Yusril explained that the AD/ART was made by political parties on the orders of the law. However, according to Yusril, so far there is no institution that examines when the AD/ART of a political party contradicts the law or the 1945 Constitution.
According to Yusril, there is a legal vacuum to resolve such problems. The party court, he said, had no authority to examine AD/ART.
Refuting Yusril’s argument, Andi also gave the example of the UN’s AD/ART. He admitted to studying the UN AD/ART.
Andi mentioned that the UN AD/ART declared the party court as the final interpreter of the party’s constitution. Then, the upper house of the United Nations called the party council assembly is given the authority to approve or disapprove of the party congress.
“So Yusril’s fiction of legal vacuum is strange,” he said.
Yusril became the attorney for four former cadres of the Moeldoko Democrat Party who sued the Democratic Party’s AD/ART to the Supreme Court.
The four people who were assisted by Yusril were Democrat cadres who had been fired by Agus Harimurti Yudhoyono (AHY). They were fired because they attended the Extraordinary Congress in North Sumatra which appointed Moeldoko as general chairman.
The Minister of State Secretary of the era of President Susilo Bambang Yudhoyono (SBY) admitted that he wanted to be the legal representative of four Democrat cadres for the Moeldoko camp for a healthy democracy. He considers it important that the lawsuits submitted by the four cadres to the MA.
“We believe that the testing of the Democratic Party’s AD/ART to the Supreme Court is very important in building a healthy democracy in our country,” said Yusril in his official statement, Thursday (23/9).
