Your Money: ONP: Consumer Defense approves withdrawal of up to S / 4,300 for affiliate

The Consumer Defense Commission approved – with seven votes in favor – the opinion of bill 4977 that establishes the procedure so that active and non-active contributors can access the withdrawal of contributions made to the National Pension System (ONP) with the purpose of protecting the family economy.

Specifically, it authorizes inactive contributors to the ONP who have not made contributions in the last 12 months so that they can voluntarily withdraw up to 100% of the total contributions made during their working life.

If of active contributors, the extraordinary withdrawal of up to 1 UIT (S / 4,300) of their contributions is authorized.

How would the delivery of contributions be? At case of non-active contributors delivery would be as follows:

  • 34% within a maximum period of 30 calendar days after the application is approved before the ONP.
  • 33% after 60 calendar days computed from the first disbursement.
  • 33% at 90 calendar days computed from the second disbursement.
  • The disbursement of the interest generated by the contributions made will be delivered within 60 calendar days of the third disbursement.

In the case of active contributors, delivery would be as follows:

  • 50% within a maximum period of 15 calendar days after the application is approved before the ONP.
  • 50% at 30 calendar days computed from the first disbursement referred to in the previous paragraph.

The opinion adds that the withdrawal of the funds maintains the status of intangibles, and cannot be discounted, legal or contractual compensation, embargo, retention, any form of affectation is of a judicial or administrative order.

It is also added that the ONP will determine the operating procedure to calculate the contributions, including the interest generated by the contributions made, within a period not to exceed 15 calendar days after the publication of the standard.

It is included that the answers to The requests of the contributors will be made within a maximum period of 7 business days, otherwise positive silence will apply.

Finally add a complementary provision for the ONP to grant an extraordinary bonus of S / 2,000 to the pensioners of Law 19990 charged to the pension debt that the State maintains with the public pension system to alleviate the emergency situation by COVID-19.
