The father of the family admitted in court that he grabbed the boy by the head and ears and shook his head. However, he denied abusing the boy.

The man claimed to have defended his family from systematic vandalism by young people.

The young people riding mopeds and driving cars had taken the family as their target. The family’s small children were afraid and had symptoms.

The young troublemakers deliberately drove down the small street in front of the family’s house and burned rubber, gassed loudly, flashed lights and honked their horns. The family mailbox had been blown up. On that particular day, the troublemakers had threatened to play the subwoofer in front of the house.

According to the father of the family, he had stopped the car in which one of the worst troublemakers was sitting, i.e. the boy, whom he grabbed by the ears.

Evidence of the accused

The incident took place in a small municipality in the Lappeenranta region in October 2021.

Today, a 53-year-old man was charged with assault. The victim boy demanded 500 euros from the man in the South Karelia district court for pain and suffering as well as legal expenses.

The accused provided the court with numerous different pictures and videos of car hoses near his home. One picture shows a broken mailbox.

In court, the man admitted that he had possibly overreacted. Rather than arresting him, he should have ordered verbally.

There was a disturbance

The girl who was with the boy testified on behalf of the abuse, according to which the man had not reacted in any way, even though she had asked him to release his grip on the boy. According to the girl, they had no intention of playing the subwoofer.

According to another witness, the young people “for a change sometimes” drive the accused’s home road to the Sale store located a couple of hundred meters away.

The district court stated that it is in itself credible that the accused’s family has been harassed.

However, no emergency shelter

However, it did not reliably appear from the written evidence that the perpetrator was specifically the person concerned in this criminal case, i.e. the boy whom the man grabbed by the ears.

It has not been shown that the young people or the boy in question disturbed the defendant’s domestic peace or were about to disturb it at the time of the crime.

It wasn’t about any emergency protection, it was about abuse.

500 euro compensation

The district court sentenced the man to a 30-day fine for assault, of which EUR 1,140 must be paid. In addition, the man must pay the state a crime victim fee of 80 euros and evidentiary costs of 114 euros.

The man must pay his victim 500 euros in compensation and 165 euros in legal costs. The man must also compensate the victim’s court costs of 495 euros.

The district judge’s verdict, given before last Christmas, did not receive legal force from the outset, as the father of the family appealed to the Court of Appeal of Eastern Finland.

However, the appeal reached the threshold of the Court of Appeal. The Court of Appeal stated this week that it will not grant the man permission for further processing.
