Young Gamer Sues Nintendo Over Mario Kart Tour’s Loot Box Mechanics

A young gamer, with the approval of his parents, is suing Nintendo for Mario Kart Tour’s gashapons, or loot box mechanics, in which players receive random items from the Spotlight store.

Essentially, the plaintiff (who spent $170 on Mario Kart Tour through his father’s credit card) argued that Nintendo deliberately made the game difficult to play without paying for it, reinforced practices like gambling, and introduced them to minor.

Nintendo has already removed the loot box mechanic from Mario Kart Tour, and did so late last year. While the lawsuit does have ground, as Nintendo’s former mechanic did violate Washington state consumer protection law and California business law, the gaming giant does have a habit of getting out of this kind of lawsuit fairly easily, so we’ll See what happens as the situation develops.
