An Irish employment dispute resolution body has ordered X (formerly Twitter) to pay a fine of £470,000 (€547,480) for the unfair dismissal of a former executive who was deemed to have resigned after the company was bought by Elon Musk.

The Workers’ Rights Commission (WRC), which hears employment disputes in Ireland, ordered X to pay the sum to Gary Rooney, theIrish Times reporting that it was the largest fine for unfair dismissal imposed by the body.

Gary Rooney, a former senior executive at Twitter’s European headquarters in Ireland, was told he had resigned after he failed to respond to an email sent by Elon Musk after the Tesla boss bought Twitter in late 2022. The email presented a vision of a “Twitter 2.0” that called on employees to be hardcore, with Musk writing: “If you are sure you want to be part of the new Twitter, please click yes on the link below”Those who did not click “yes” were informed in the email that they would receive three months of severance pay.

Gary Rooney had worked at Twitter for nine years before being considered for resignation in November 2022.

Gary Rooney’s decision not to click “yes” on the email did not constitute a resignation, WRC chief Michael MacNamee concluded in a ruling. The full decision will be made public in late August.
