Würzburg: Trial of sex with prisoner ends with suspended sentence

The nurse was charged for having sex with a patient in 2018. The 39-year-old was working in the Lohr district hospital (Main-Spessart district) when she began the affair with the inmate. Although the intercourse was consensual, they were alleged to have been sexually abused. According to the prosecutor, she had abused her position as a responsible person.

In March 2020, the Gemünden District Court imposed a suspended sentence of eight months and a two-month driver’s license withdrawal because the sex is said to have taken place once in the car. The prosecution and defense appeals.

The 39-year-old was represented by her lawyer during the appeal process. It mainly concerned the two-month long driving ban, which meant significant restrictions for the mother of one child. Because of her new job, she would find it difficult to get to work from the village by public transport due to night shifts.

The public prosecutor’s office, which had also appealed and initially wanted to demand eleven months probation, agreed at the hearing that the driving ban should be abolished if the suspended sentence was increased by two months. According to Richter, the affair was a “misstep” that the defendant will certainly remember every day when she commutes to her new job.
