The woman had successfully maneuvered her 3.6 meter long car into the 4 meter long parking space at the beginning of December 2019, writes the Federal Court in a judgment published on Tuesday. The driver had to make corrections several times and was noticed by a police patrol who wrote a report.
Nudging the front and rear cars did no damage. The parking thus had no criminal consequences, but the canton police ordered a trip accompanied by an expert. The woman resisted this without success – until the federal court has now found her right.
Age alone is not decisive
Inspection drives may not be ordered solely on the basis of a person’s age, explains the first public law department in its considerations.
Rather, there must be a serious driving error, which regularly also has criminal consequences. However, a control trip could also be indicated if someone had caused several accidents within a short period of time.
