A woman in her thirties who allegedly had been raped by actor Cho Jae-hyun (56) at the time of her childhood filed a lawsuit for shipping billions of damages, but it was not accepted by the court.
The 17th Division of the Civil Agreement of the Seoul Central District Court (President Judge Sang-ju Lee) ruled that the plaintiff was defeated in a lawsuit for damages of 300 million won by a woman A against Cho.
Mr. A filed a lawsuit for damages of 300 million won in July 2018, claiming that he had been raped by Cho in 2004 when he was 17 years old.
After that, the lawsuit was referred to mediation, and the court made a decision for compulsory mediation, but Mr. A refused to accept it and filed an objection and a formal trial was held.
In the course of the defense, Mr. A claimed that he filed a lawsuit in terms of “delivering the pain he suffered.” On the other hand, Mr. Cho said, “It is not true,” and refuted that “this case is an event that the completion of the extinctive prescription is obvious.”
According to Article 766 (1) of the Civil Code, the right to claim compensation for damages due to illegal acts shall expire if the victim or his/her legal representative does not exercise it for three years from the “day of knowing the damage or perpetrator”.
