Light the blanket on fire with a lighter… “Assault damage, extenuating circumstances”
Panoramic view of Jeonju District Court. News 1 DB A woman in her 40s who was arrested and indicted on charges of setting fire to her boyfriend’s house while drunk and causing her death, and was sentenced to 12 years in prison in the first trial, claimed mental and physical weakness in the appeal trial.
On the 20th, the first appeal trial for Mr. A (42), who was arrested and indicted on charges of arson of a Hyeonju building causing death, was held at the Gwangju High Court Jeonju Trial Division (Chief Judge Yang Jin-soo).
On this day, Mr. A’s lawyer argued, “The defendant had no intention of murder and was mentally and physically weak at the time of the crime.”
Mr. A’s lawyer then said, “Please take into account the fact that the defendant committed the crime after being repeatedly assaulted and beaten by the victim,” and added, “I will submit an application for mental evaluation for mental and physical disorders such as mental loss and mental weakness, so please proceed once.” “I will give it to you,” he asked the court.
The next trial for Mr. A will be held on December 4.
Mr. A was arrested and indicted on charges of murdering her boyfriend, Mr. B (30s), by setting fire to a detached house in Impi-myeon, Gunsan-si, Jeollabuk-do around 3 a.m. on May 11.
As a result of the investigation, it was revealed that Mr. A committed this crime after being assaulted by Mr. B while they were drinking together, and could not control his anger.
According to the court, Mr. A set fire to the blanket with a lighter when Mr. B, who was drunk, fell asleep. After the crime was committed, Mr. A even watched it from outside the house.
The police arrested Mr. A, who was sitting in an intoxicated state near the outdoor toilet of the house where the fire broke out.
As a result of confirmation, it was found that they had been dating for about 5 years since 2019, and that Mr. A had always harbored a grudge against Mr. B for his repeated violence.
The first trial court said, “The defendant committed a very serious crime, including setting fire to kill the victim while she was sleeping,” and added, “Even after comprehensive review of various circumstances, including the fact that the defendant did not make any effort to receive forgiveness from the bereaved family, a severe punishment is not warranted.” He sentenced him to 12 years in prison, saying, “It is inevitable.”
