Winterthur must review approvals granted for 5G antennas

According to a federal court ruling, the Winterthur building committee must deal with converting various antennas to 5G technology. If adaptive antennas have been installed, subsequent building permit procedures must be carried out.

The Federal Court has approved a complaint from Dominik Krämer, President of the “Smart Radio and Fiber Optic” association. He complained, among other things, that the switch to 5G technology with the installation of adaptive antennas in certain locations had been inadmissibly approved in the so-called minor change procedure .

The highest Swiss court has already decided in an earlier ruling that this approach is not permitted. The adaptive antennas would automatically change their transmission direction and antenna pattern using algorithms at short intervals without changing the mounting equipment. This means that the signal is transmitted in the direction where it is requested by the end devices.

This could lead to a different spatial distribution of radiation. Under certain circumstances, there may be an increase in field strength at locations other than the previous ones. In the case of such a change, there is a public interest in being able to check it before the change is approved, which is why a normal approval procedure must be carried out.

The matter now goes back to the Winterthur building committee. This must examine where the minor change procedure was wrongly used and in these cases give the operators a fair hearing if there is a subsequent building permit procedure. In addition, the committee must decide on the complainant’s requests to switch off or dismantle certain antennas. (dab/sda)
