The report of the State Commissioners Authority of the Administrative Court, which was deposited by the Authority today, in which it recommended the cancellation of the Olympic Committee’s decision to suspend Mortada Mansour from practicing sporting activity for a period of 4 years and freeze him as president of the Zamalek Club and to call for the election of a new president of the club. Judicial sources confirmed to Al-Masry Al-Youm that what the Commissioners ’Commission recommended in its report was an“ advisory opinion ”regarding an appeal against a specific decision, which is stopping the former president of Zamalek from practicing any sporting activity for a period of 4 years, and that the appeal and the report were not exposed to this issue in the face of Determination, which is the return to the presidency of Zamalek or not.
The sources added that the report of the State Commissioners Authority after it has been deposited with the court will be nothing but a consultative reference for the court to take it or not, so that in the end its ruling remains the final say in the appeal and nothing else.
Regarding the court ruling scenarios, the sources said that the administrative judiciary, when confronting an administrative decision appealed against, either the court issues a ruling confirming this decision or stopping its implementation, and the same is the case for the appeal filed by Mortada Mansour, either the court issues its ruling rejecting it and supporting the decision to freeze Mortada, or a ruling By canceling the decision and stopping its implementation, and thus its consequences.
It is noteworthy that the State Commissioners Authority at the Administrative Court had recommended in its report the legal opinion on this challenge to refer Article 67 of Sports Law No. 71 of 2017 to the Constitutional Court to decide on the extent of its constitutionality, after it was deemed to have a suspicion of unconstitutionality in it, for contravening the special constitutional principle A citizen has the right to resort to his natural judge, while this article obliges litigants in sports disputes to resort to the Sports Arbitration and Settlement Center.
The commission also concluded that there is no state jurisdiction to hear the appeal before the court, and the interference of Hani Al-Atal and Mamdouh Abbas is accepted as opponents in the lawsuit. And the referral of the text of Article 67 of the Sports Law to the Supreme Constitutional Court to decide on the extent of its constitutionality.
It is worth noting that the Olympic Committee issued on October 4 of last year its decision to prevent the president of Zamalek Club for 4 years from practicing any sporting activity, after several violations attributed to him were proven, and it requested elections to choose a new president for the club, so Mortada Mansour appealed the ruling before the administrative court
