In addition, he claims to defend himself in the face of Nintendo’s lawsuit, so he will not have a lawyer in judicial matters in the state of Seattle.

But those are not all the problems for Daly, since the Japanese company also accuses him of the fact that the consoles that he sold in his store already had pre-installed games at the time of their marketing.

However, Daly claims to have listed 17 “affirmative defenses”, which present supposed “evidence” that could exempt them from the charges awarded by Nintendo. For example, fair use of hardware and invalid copyrights. Daly plans to conduct his defense without the advice of a lawyer, and on his own through a Seattle court.

At the moment Nintendo has not responded regarding this, nor has a date been given for an official trial in said state, so we have to wait for the resolution of this lawsuit and how Daly will proceed given that he does not have an expert lawyer in these types of copyright situations and illicit sale of modified hardware.
