Inheritance proceedings in the Czech Republic are court proceedings and are not public. A notary appointed by the court as a judicial commissioner performs acts ex officio without undue delay.

“Due to the fact that in the proceedings it is necessary to address a number of persons and offices from which the notary collects information about assets and there is, for example, no comprehensive overview of bank accounts and other products, the length of the proceedings is not entirely in the hands of a notary,” said notary Daniela Anderson.

“The standard inheritance proceedings are in the order of months. If the subject of inheritance is a larger property or it is necessary to find out the heirs extensively, or there is an international element in the proceedings consisting in the fact that the heirs or property are located abroad, then we can talk about many years, “she added.

According to European law, the whole inheritance proceedings take place in principle in one state, which is the state of the testator’s habitual residence, ie the place where he actually lived. This is intended to simplify and speed up the procedure, where in principle there is no need to discuss the various parts of the testator’s property in different countries.

“In general, it’s a good idea to make a will. This is all the more true the more potential heirs or property there are. This eliminates possible conflicts between heirs and facilitates the identification and division of property, “added Anderson.

The Czech Republic can be dominated by Vítek

Last year, according to the Forbes magazine, the owner of the CPI Property Group, Radovan Vítek, was the second richest Czech with a fortune of 86 billion crowns, and the third was the owner of the Energy and Industrial Holding or football Sparta Křetínský with 78 billion crowns of assets.

Economist Lukáš Kovanda pointed out that Vítek could become the richest Czech in this way, but it depends on how the deceased Kellner treated his extensive heritage. “If Kellner’s property were now settled without an inheritance contract or will, he would be divided equally among the five persons in the inheritance: the entrepreneur’s four children and his wife,” Kovanda stated.

“Radovan Vítek would thus become the richest Czech, while Kellner’s heirs would share fifth place. In addition to Vítek and Křetínský, Andrej Babiš and Karel Komárek would also be in front of them, “he added.

If Kellner decides to treat the inheritance of the property after his death by inheritance contract or will, the situation may be completely different. “One of the possibilities in such a case is hypothetically that some or some members of Kellner’s immediate family – children and wife – thus find themselves at the top of the list of the richest people in the Czech Republic,” Kovanda added.
