Who pays for corona closings? Restaurateurs complain | NDR.de – Nachrichten – Lower Saxony

Status: October 21, 2020 8:45 p.m.

Is the corona shutdown in March a company closure that insurance companies have to pay for? Ten East Frisian restaurateurs and hoteliers want to clarify this at the Aurich district court.

According to the court, the amount in dispute in the proceedings is between 5,000 and one million euros, as reported by NDR 1 Lower Saxony. Specifically, it is about insurance policies that the plaintiffs had taken out in the event of a business closure.

According to the court, “preventive” reasons are not insured

Such insurances are not designed for a pandemic, said a spokeswoman for the Association of the German Insurance Industry. As a rule, they apply if diseases such as salmonella or noroviruses that are self-insured occur in the company and the company is therefore closed by the state. If companies are closed for preventive reasons, this is not covered.

Similar lawsuits at the Regional Court of Oldenburg

The Oldenburg Regional Court is also increasingly dealing with similar cases. A week ago, the chamber ruled in favor of the insurance, as NDR 1 Lower Saxony reports on. In Munich, however, an innkeeper was right. According to the press spokesman for the Oldenburg Regional Court, no verdict is indicative for other plaintiffs. In individual cases, it depends on the exact wording of the insurance conditions.
