The prosecutor’s office attached to the High Court of Cassation and Justice announced suspicions in the case of the biggest tragedy that took place at the ATI Section of the Neamţ County Hospital, six former managers, two doctors and two nurses being charged.

According to Adevărul information, the head of the ATI Department, Liviu Ungureanu, is being prosecuted for culpable homicide and bodily injury and another doctor of the medical unit.

The prosecutor’s office of the supreme court also officially specified the cause of the fire, a candle lit on a patient’s bed in an oxygen-enriched atmosphere that was not ventilated, as it normally should have been.

“The criminal investigation continues (…) also against another natural person, a doctor at the ATI department (…) consisting in the fact that, in the exercise of his attributions, he would have drawn up and signed an address dated 18.06.2021, which contains false information on the care given to patients during the fire. They used this address by sending it to the Neamţ County Forensic Medicine Service, where it was taken into account when carrying out the medico-legal works regarding the death of two people, in order to hinder the criminal investigation “, it is shown in the communiqué of the General Prosecutor’s Office.

What is imputed to the nurses

In this case, two other nurses are being prosecuted, for culpable homicide, culpable bodily harm, culpable destruction in a qualified form and failure to take legal measures for safety at work. They cared for COVID patients who were given oxygen and “would have used and left unattended an open source of fire – a candle, in the context of a patient’s agony. This would have been the source of initiating the fire with the consequence of setting fire to the 240 ATI salon “, according to the quoted source.

An institution, in this case Neamţ County Hospital, is also being prosecuted for culpable homicide, culpable bodily harm and culpable destruction. Prosecutors believe the unit did not conduct a safety risk review following changes in working conditions following the COVID hospital’s nomination and the adoption of an oxygen-boosting therapy. Under these new conditions, he would not have established preventive measures to ensure the health and safety of the ATI Department, he did not take measures to proceed with activities capable of leading to ventilation in ATI wards, to ensure the safety of medical staff and patients, as well as and supportive medical care in the event of a gas outage.

As for the six former managers of the Neamţ County Hospital from March 31, 2020 to November 17, 2020, in the context of the pandemic, they would have improperly organized the specific activity at the unit level: patients, the bodily injury of a nurse and a doctor, the degradation of the salon, the destruction of medical fluid installations and other medical equipment “, according to the ICCJ Prosecutor’s Office.
