Magdeburg (dpa / tmn) – Anyone who says to the insurance company that they park their car in a garage at night should really always do so. Because if it comes before it, the insurance may reduce the claim after a theft. This is shown by a judgment of the Magdeburg Regional Court (Az .: 11 O 217/18), reported on the traffic law working group of the German Lawyers’ Association (DAV).
In the specific case, it was agreed with the comprehensive insurance that the owner would park his car in a garage at night. That had given him a more favorable classification. When the car was stolen one night, however, it was in front of it. This was usually the case once a week. The insurance company then cut its benefits by 40 percent, which amounted to around 20,000 euros. The robber complained against this.
However, this was only partially successful in court. So the insurance was still allowed to cut by 30 percent. In the eyes of the judges, the danger is greatly increased if the car is not parked in but in front of the garage. A further complicating factor was that the data from the car key could be read out. From a locked garage, the thieves would not have been able to drive the car away so easily. However, the court took into account that the plaintiff did not park his car in a public parking lot.
