What is the process for making names of fugitive criminals public? High Court asked for report from Delhi Police

New Delhi. The Delhi High Court has sought a report from the Delhi Police on the process followed for uploading the names and details of fugitive criminals on a public platform and their verification. The High Court had earlier asked the National Informatics Center (NIC) to develop a software and other facilities to upload the names and details of fugitive criminals so that people can help the police by giving information about their whereabouts.

The court said that this would help the state to take further action against him. However, during the recent hearing, the court was informed that clarification is needed regarding which agency has to follow its earlier instructions. Justice Amit Bansal said, “Let a brief report be filed by the DCP (Legal Division) of Delhi Police regarding the process to be followed for verification and uploading of the said data.”

Next hearing will be held in December
Delhi High Court has listed the case for further hearing in December. It had earlier said that a committee appointed by the court under the chairmanship of the Principal District and Sessions Judge (Headquarters) would monitor the implementation of its directions. Senior advocate Arun Mohan was appointed as amicus curiae in this case.

There was confusion over the responsibility of the agency
He told the court during the hearing that in the last meeting of the committee it came to light that there was some ambiguity regarding the instructions given by the High Court in May. The High Court said that the ambiguity pertains to which agency is responsible for uploading the data of fugitive criminals.

That instruction said, ‘As far as uploading of data is concerned, Delhi Police will be responsible for uploading the data of fugitive criminals/fugitive persons declared by the courts in criminal cases registered by Delhi Police.’ In the May judgment, the high court had said that the data would be initially uploaded on the internal server and later on the public platform developed by NIC after verification.
