“What is happening is illegal”

The lawyer Adrian Cuculis presented the case of a building in Ilfov for which an invoice was issued after recalculation of 22,000 euros. Here’s what we need to pay attention to.

ANRE fined several electricity suppliers for delayed issuing of invoices.

Electricity suppliers have been sanctioned by the National Energy Regulatory Authority (ANRE) with 380,000 lei, for the issuance of late invoices.

“The object of the control actions was the verification of how, in the period 01.04.2022 – 30.09.2022, the suppliers fulfilled the obligation to issue invoices according to the billing period agreed with the end customers.

Following the checks carried out, it emerged that the audited suppliers did not comply with legal obligations, or that they issued late or did not issue electricity invoices after each billing period, were sanctioned with penalties for a total of 380,000 lei “, informs Wednesday. ANRE, in a press release.

The largest fine was applied to Electrica Furnizare – 120,000 lei, followed by Hidroelectrica – 70,000 lei, CEZ Vânzare – 60,000 lei, E.ON Energie Romania – 50,000 lei, Enel Energie – 50,000 lei and Enel Energie Muntenia – 30,000 lei.

Invoice of 109,000 lei to Bragadiru, Ilfov: “Following the failure of the Romanians!”

However, the situation of the large invoices received continues even after the regularization. This is the case of a building in Bragadiru, Ilfov, which received a bill of 22 thousand euros after the regularization.

The action is illegal, says lawyer Adrian Cuculis. Here because.

“It is very interesting because this figure that the Anre announces, with trumpets and trumpets, actually means about 3 bills from what I announced today, that is, you put in another billion per billion per billion and you have solved the problem with the fine.

“You can’t pay that much for any kind of house in this country”

Let’s take a look, a few months ago 20,000 lei looked huge. This means paying almost 5,000 euros per invoice.

Now it doesn’t seem like much anymore, because we have bills of 22,000 euros and obviously we are not talking about a two-room apartment, we are not hypocrites, but you can never, for any type of house in this country, pay so much a recalculated bill.

Why is the recalculation displayed. The 2019 – 2021 regularization has been made, a recalculation that, as you can see, even at the moment somehow ended up not being updated.

“The consumer is not interested in the problems of the billing system”

Because there are big problems with the billing system and this billing system which obviously has been messed up by all the legislative changes, which are of no interest to the final consumer.

What we can say at the moment is the following: that we will, of course, in the future, and that the future is not too far away, maybe even in December to overlap the misfortune that awaits us with regard to winter heating, we will have great surprises, because, as you can see, 3 months is the maximum period in which regularization can be done.

“Regulation for more than 3 months is illegal”

These people, the suppliers, not receiving the index or even asking the distributor if they received it or not, do the regularizations years ago, which is illegal.

Failure to issue invoices must be corroborated by issuing invoices legally, because if you have done a regularization for more than three months, from my point of view and from a legal point of view, that consumer should not pay you, but they must notify you. and, of course, recalculate or perform an actual failure.

Moving on to exhaustion, come for nothing and tell him that I am doing your exhaustion for 3 months and another 3 months if you go back 3 years.

So somehow this situation should be assumed, we do not set prices of 10 or, I know, 11 lei per kilowatt hour including excise duty and VAT, given that the consumption was made in 2020 or 2019 and somehow this situation has to be adjusted all the time. ‘ANRE level, because they have this possibility.

In fact, there are some membership contracts out there that also have unfair terms.

The climax is and I find it absolutely cynical. I’ll give you an example from the court, just yesterday.

One of the supplier companies you introduced earlier comes along and says the following: Sir, we never said we were disconnecting you, for nothing, you are suing us, that we won’t.

At the level of words they are very clever, but at the level of facts, look what really happens, when the electricity in the house and an oxygen concentrator run out, “explained the lawyer Adrian Cuculis in the show Descoperiți of Antena 3.
