“We’re not opening”: store openings in protest – postponed!

Business owners across Germany wanted to open their shops to protest the lockdown. Now the “We’re opening up” action has been postponed.

The interest was and is great: For a week now, business people all over Germany have been considering whether to take part in the “We open” campaign that was broadcast on Telegram – originally planned for Monday, January 11th, 21st. Tens of thousands of self-employed people who have suffered from two lockdowns plus extension have joined the group in the messenger service since last Saturday. But shortly before it should start, the action has now been called off!

He is not backing down, said initiator Macit Uzbay on Telegram. “On the contrary,” he emphasizes in a voice message. The action is now “completely secured”. He doesn’t want anyone to be harmed. One must first clarify the legal situation more precisely and act with caution. The aim is not to “just open up at random”. Rather, “the government must be given a deadline of seven days,” said Uzbay. According to the new plan, business people who want to take part in the “We’re opening up” campaign should open their shops on Monday, January 18th, 21st.

Lawyers support “We open up”

The legal consequences of a “wild” exit from lockdown had been discussed on the Internet for days. Lateral thinking lawyer Ralf Ludwig supports “We open”, but pointed out that there was “no absolute legal security in advance”. In the Nordkurier, the Hamburg lawyer Rolf Karpenstein had examined the lockdown – also with regard to the planned store openings – from a European law perspective. He sees European law as a potential point of attack to bring down the corona measures against entrepreneurs.
