/ world today news/ Bulgaria may not absorb a large part of nearly 2.5 billion euros of European funds for new infrastructure in the period 2014 – 2020. This was announced by the Ministry of Regional Development to BNT.
The reason for this may be the decision of the Constitutional Court, which accepted the arguments of the ombudsman Konstantin Penchev against the changes in the Law on Territorial Planning, which make it possible to start construction in private property before the expropriation procedures have been completed.
The changes were made to speed up the construction of new infrastructure. In its reasons, the Constitutional Court rejected the amendments to the legislation, as there is a danger that the state and municipalities will violate the inviolability of private property. According to the constitutional judges, whose decisions are not subject to appeal, as a rule of law Bulgaria cannot allow anyone to dispose of or use someone else’s property against the will of the owner. Although the court’s decision has put the institutions on edge, they admit that it is indeed fair.
“The provisions were introduced into the law to facilitate the expropriation procedure given the many owners of the land – this is clear to everyone. This is, of course, the right of each owner to be notified, to be compensated – I do not dispute this,” he commented. the Minister of Regional Development and Public Works Desislava Terzieva (pictured right). That is why Terzieva assigned the ministry’s lawyers in August and September to present proposals for amendments to the legislation. The aim is to ease and speed up the expropriation and compensation procedures for the owners of the lands where new infrastructure and roads will be built.
“Otherwise, I don’t know how we’re going to go with construction from here on out. There’s definitely going to be a delay. Imagine the next program period, which will be maybe somewhere around 2 billion – 2.5 billion we’re budgeting for road construction, so imagine what kind of threat is there really”, Minister Terzieva added.
