The Delegation of the Government in Madrid has given the green light this Thursday to the demonstration on wheels that Vox has called next Saturday at noon in the Salamanca district, in the center of Madrid, to demand the resignation of the Government for its management of the pandemic . The approval of the Government Delegation comes after the favorable reports of the State Attorney, the Citizen Security Police Station of the National Police Force and the Ministry of Health of the Community of Madrid, which has not seen a high risk of contagion in the March.

This morning, the Supreme Administrative Prosecutor’s Office sent a letter to all the superior prosecutors in which it reminds them that the state of alarm does not in itself constitute an “adequate and sufficient legal justification” to suspend the right to demonstrate and He urges them to study the cases on a case-by-case basis to ensure that the protest does not increase the risk of contagion.

The demonstration, on board private vehicles and carrying Spanish flags, will begin at noon in Plaza de Cibeles and will take place on a circuit through the Salamanca neighborhood that runs along Paseo de Recoletos, Plaza de Colón, calle Goya, Serrano and the Puerta de Alcalá. Initially, Vox had asked that the demonstration go through Paseo de la Castellana, but by day it is partially pedestrianized during the weekend, so it was urged to change the itinerary.

Vox requested the holding of marches on board vehicles in the 50 provincial capitals, plus Ceuta and Melilla. For its part, the Ministry of the Interior, which has assumed the powers of the Ministry of the Generalitat during the state of alarm, prohibited those of Barcelona, ​​Tarragona, Lleida and Girona, alleging reasons of sanitary security and the impossibility of maintaining distances. Vox appealed these latest prohibitions to the Supreme Court, which on Wednesday passed the ball to the Superior Court of Justice of Catalonia (TSJC).

For its part, the Superior Court of Justice of Castilla y León (TSJCyL) has estimated the resources of Vox and has declared void the resolutions of the Government subdelegations, which prohibited the demonstrations on wheels called on May 23 in all the capitals of region, except Ávila. The Court recognizes the party’s right to demonstrate despite the fact that the concentration was not authorized in the first instance due to the “risk to public health” that they entailed, according to a report by the Board’s Ministry of Health. The nine provincial capitals are still in phase 0 according to a system that has applied de-escalation by basic health zones.

On April 30, the Constitutional Court endorsed the prohibition by the Superior Court of Justice of Galicia of the demonstration called on the occasion of May 1, in Vigo. The high court considered that, although it was a march in cars with one person on board each, there was a “lack of security guarantees in a situation of maximum [riesgo] contagion ”; therefore, in the balance between the right to life and the right to assembly, the “first right” should prevail.
