During the meeting of the Budget, Finance and Banking Commission of the Chamber of Deputies, held today, 8 November, a supplementary law of the Government’s Emergency Ordinance No. 28/1999 was adopted relating to the obligation for economic operators to use electronic fiscal marking devices, Ordinance introducing new rules relating to the taxation of tip amounts, announced in a press release by Ion Biriş, President of HORA.
The organization HORA reports that it has supported this regulation of tipping income from the beginning, in essence it is a transparency of these incomes, which means not only normality on a global level, but also higher revenues for the state budget . The legislation contained in the Final Report of the Commission defines the tip as any sum of money voluntarily offered by the customer, in addition to the value of the goods delivered or the services rendered, being applicable to economic operators carrying out activities corresponding to the CAEN codes 5610 – Restaurants and 5630 – Bars and other businesses serving drinks.
Therefore, tipping remains at the discretion of the customer, who has the option of paying in cash, by card or by money order, in case of invoices, when and if he wishes. This regulation offers a new possibility to leave a tip, cash or card, even in the case of card payments.
In recent years this topic has been raised numerous times, both in public discussion, in dialogues with officials, and in the mass media, each time all participants agree that this is a natural step towards a European practice, which only in Romania has not been implemented until this date, Biriş also points out.
The HORA organization welcomes this initiative, which it does not see as an overtaxing measure, but as a measure with a 100% positive impact on all those operating in this sector.
