The Vorpommern-Greifswald district has overridden the stricter corona rules. The night curfew and the 15-kilometer rule have been lifted.
After some corona rules in the Vorpommern-Greifswald district were overturned by the court for the plaintiffs, the district canceled the general decree with the deadline of Tuesday (February 2). This was announced by a district spokeswoman on Monday afternoon. At the beginning of last week, the district imposed the stricter corona rules, according to which it is forbidden to leave your own apartment or property between 9 p.m. and 6 a.m. without good reason. Accordingly, you could not move further than 15 kilometers from your place of residence for no reason.

District Administrator Sack: The reasons for the judgment did not allow any other conclusion
District Administrator Michael Sack (CDU) said the contents of the court’s grounds for the judgment were so serious that the general decree was not tenable. The decision of the court that only the state can adopt measures such as mobility restrictions and curfews by law is also decisive for the district administration. The district of Vorpommern-Greifswald now wants to examine ways to further curb the still high infection rate, said District Administrator Sack.
Discussions between the district and the country beforehand
The decision was preceded by talks between the state government and District Administrator Sack on Monday. The district had announced on Facebook to review the general decree. “In all probability – so the decision of the court – the future regulation will have to be made at the state level,” it said. The increased protective measures against the spread of the coronavirus have come into force because the district has had a higher incidence value than 150 new infections per 100,000 inhabitants in one week and is therefore a high-risk area.

With its decision on Friday, the Greifswald administrative court questioned the legality of the night curfew and the 15-kilometer radius of movement. In the opinion of the judges, such restrictions on fundamental rights cannot be decided by a general decree of the district. Rather, it would need a statutory ordinance at the state level. That is why the Greifswald Administrative Court lifted the corona restrictions for two plaintiffs.
