Visitor sues Eataly after breaking ankle due to slippery prosciutto: Lawsuit seeks compensation for medical expenses and pain and suffering

A visitor to the American grocery store located in Boston broke her ankle in October 2022. She and her husband each filed a complaint and are seeking compensation from the ensign.

A visitor will not forget her visit to the Italian grocery store Eataly. On October 7, 2022, Alice Cohen was browsing the store of the international chain in Boston. She would have slipped on a slice of prosciutto, Italian raw ham, which was distributed to passers-by. The slip would have led to her breaking her ankle.

This story was formalized in a very serious complaint, shared by the American media. The sign that sells Italian cheese, various charcuterie, pasta or pizza was assigned to the Superior Court of Suffolk in Boston. He is accused of not having properly cleaned the floor, negligently causing this accident.

The grocery store and the restaurant “had a duty to ensure that the surface of the floors was free from unnecessary hazards, the duty (…) [de] maintain the premises in a reasonably safe condition and the duty to warn of such unsafe conditions,” according to the document drafted by plaintiff’s attorneys.

7500 dollars of medical expenses

“Alice Cohen suffered bodily injury, loss of enjoyment of life, pain and suffering, and incurred necessary medical expenses for medical care and treatment,” the complaint states, as reported. ABC News.

To repair her damage, the American claims 50,000 dollars from Eataly. A sum which must, among other things, cover its expensive medical expenses, the American health system obliges. According to court documents, his hospital visit and rehabilitation cost him more than $7,500.

The rest of the sum must cover moral damage. His injury would have caused him “great pain and suffering”, but also “loss of enjoyment for life” (sic).

In addition to the complaint filed by the victim Alice Cohen, a second was requested by her husband. He was not physically injured by ham during his visit. But Ronald Cohen would have “suffered” from the injury of his wife, who could not have fulfilled her duties as a partner. Specifically, “the love, companionship, comfort, services, support, or intimate relationships she provided to him prior to the accident,” as reported by the Daily Mail.

On the other side of the Atlantic, procedures against large brands are frequent, the culture of complaints being much more widespread there. In France, Eataly has not had a similar problem in its Paris store. The sign was however splashed by another scandal last April. A man would have placed several miniature cameras in the toilets of the sign, resulting in the capture of the passage of approximately 200 women and children.
