Former Chief Justice of the Constitutional Court Jimly Asshiddiqie reminds of changes in political parties (Political parties) cannot just happen, either in relation to replacement, ratification or dissolution.

According to Jimly, these various actions must refer to Law Number 2 of 2011 concerning amendments to Law Number 2 of 2008 concerning Political Parties.

“The minister will not arbitrarily disband or replace or just endorse because the law is regulated like that,” he said after meeting with the Chairman of the Democratic Party, Agus Harimurti Yudhoyono, Tuesday (9/3).


The statement was made following the chaos within the Democratic Party. Jimly also explained that various things related to changes in political parties are different from community organizations (mass organizations). Therefore, he continued, political party dissolution will be more difficult than dissolving mass organizations.

“I convey that this is a problem with political parties, which is different from mass organizations. In the 2008 Law or the 2011 Law on political parties. Even in the Constitution, this principle is very important for the pillars of democracy, it is important to protect it,” he said.

“So the dissolution of political parties is not the same as mass organizations, it has to be in the Constitutional Court because of its importance. So if there is a problem with the party, the minister will be at the end,” added Jimly again.

Regarding the chaos in the Democratic Party, Jimly is also optimistic that the problems within the Democratic Party can be resolved immediately. This belief was expressed by Jimly in a striking manner in the statement of the Coordinating Minister for Political, Legal and Security Affairs Mahfud MD and the ranks of the President Joko Widodo.

“So specifically for the cases faced by the Democratic Party, I am optimistic that this will reach a solution in due time. Only when is the process, how about passing it by using logic power, moral power and the agreement of laws and regulations that we have agreed on,” he said.

“Between the government and the statements that have been delivered by Pak Mahfud as well as the ministers concerned, I think they can be used as guidance,” continued Jimly.

“If the government wants to ensure its neutral stance, the government could (1) not validate the registration of the ‘KLB’ management & (2) the President appointed a new KSP to replace Moeldoko as it should be,” Jimly wrote in his personal twitter account @JimlyAs, Saturday (6 / 3).
