FA man has been sentenced to imprisonment by the Darmstadt Regional Court for attacking his wife with a stone. The 55-year-old family man from Dietzenbach has to go to prison for five years and three months after Tuesday’s verdict for dangerous bodily harm. According to the judges, he had hit his 52-year-old wife with a stone weighing almost a kilogram during a bicycle trip.
The court assumed the wife survived because the defendant let her go when she yelled at him. The act was actually “the classic attempted murder”, said the presiding judge Volker Wagner. However, since the man did not complete the murder of his own accord, the court rated the attack as dangerous bodily harm. The judges followed the defense with their verdict. The prosecutor had pleaded attempted murder.
The fact that the defendant will pay his wife 40,000 euros in damages and grant her a ten-year right to live in the house they shared had a mitigating effect on the sentence. The background to the crime was that the accused wanted to live with his girlfriend. The 43-year-old had expected him to leave his wife. The verdict is not yet legally binding.
