The messenger service WhatsApp, a subsidiary of the US company Facebook, has to pay a fine of 225 million euros in Ireland. That was the verdict of the Irish Data Protection Commission, or DPC for short. According to DPC, WhatsApp does not provide sufficient information about how and where the personal data of users are passed on. The messenger service thus violates the European General Data Protection Regulation.
The Irish Data Protection Commission instructed WhatsApp to change its data processing. The messenger service itself announced legal action and described the punishment as “completely inappropriate.”
“Small step in the right direction”
Ulrich Kelber, the Federal Data Protection Commissioner, described the decision of the Irish Data Protection Commission, according to Zeit Online, as a “small step in the right direction”: “Now the point is that the many other open cases relating to WhatsApp are finally decided in Ireland so that the steps can be taken uniform enforcement of data protection law in Europe will become faster and longer. “
Transparency obligation
The Irish Data Protection Commission had already opened proceedings against the WhatsAp messenger service in 2018, the year the European General Data Protection Regulation came into force. The proceedings also affected the parent company Facebook, whose European headquarters are in Ireland.
