The government and the DPR have agreed to change the status of the new capital city as stated in the Draft Law on the State Capital (RUU IKN) became a special regional government for the National Capital.
This phrase changed the name of the State Capital in the IKN Bill, which was previously named the Special Government of the State Capital. The agreement was taken in a follow-up meeting between the government represented by Bappenas and the Panja IKN Bill from the Indonesian House of Representatives, Wednesday (15/12) night.
“The first is a change from the government’s diction specifically for IKN, to a regional government specifically for IKN,” said Minister of National Development Planning (PPN) / Head of the National Development Planning Agency (Bappenas) Suharso Monoarfa.
He explained the changes in the bill because in the previous draft, the phrase special government for the State Capital, contradicted Article 18B paragraph (1) of the 1945 Constitution. For information, the article stated, “The state recognizes and respects units regional government units that are special or special in nature regulated by law”.
Referring to the article, the Constitution does not recognize another form of government as mentioned in the previous IKN Bill, namely the State Capital Special Government.
In addition, explained Suharso, his party also received a proposal from the DPD to include four paragraphs in Article 22D of the 1945 Constitution which regulates the DPD’s authority in the field of legislation, including submitting certain bills, participating in joint discussions with the DPR and the Government on the preparation of certain bills, as well as providing views and opinions. against certain bills.
“The change is in order to ensure compliance with article 18B, paragraph 1, 1945 Constitution. The proposal of the district representative council to include article 22D, 1945 Constitution is acceptable,” he said.
In addition to agreeing on the phrase special regional government for IKN, the DPR and the government also agreed to change the institutional concept of the IKN authority: from the beginning being able to carry out government functions, to being only a function of preparation, development, and relocation of the State Capital.
“Then, the administration of government by the regional government specifically for IKN, in the new formulation, the administration of government in IKN is carried out by the regional government specifically for IKN,” said Suharso, who is also known as the General Chair of the PPP.
Responding to this, a member of the Special Committee (Pansus) for the IKN Bill from the PPP faction, Achmad Baidowi, said it was reasonable to agree that the IKN Bill would not conflict with the 1945 Constitution.
In addition, in the future, the Special IKN Regional Government according to the IKN Bill will have special characteristics. Among other things, do not have a DPRD, Regent, or Governor. IKN will only participate in political contestations at the central level, namely the Legislative and Presidential Elections.
“Is it possible? As long as it is regulated in the IKN Law. Because the constitutional order is for the regional government to be special or special dartah regulated by the IKN Law. It is excluded from the provisions of the Pilkada Law article,” he said, Thursday (16/12).
