The sale of land in the private domain of the municipality was voted yesterday for the benefit of the owners of two villas, route des Sanguinaires. The case of two private houses, Sanguinaires road, once again animated the city council, Monday evening. Presented at the very end of a dense and disjointed session, two deliberations were presented by Nicole Ottavy. They authorize the mayor toAjaccio to sign the deed of sale of two land in the private domain of the municipality, from the cadastral plot section CP number 134. The first with an area of ​​232 m2, for the benefit of Michel Majdi Amhan, at the session price set at 67,744 euros; the second with an area of ​​668 m2 for the benefit of Damien Amhan, at a price of 195,056 euros.

These deliberations relate to two villas well known to Ajacciens due to the media coverage generated by court decisions handed down against their owners, two doctor brothers (and real estate developer for one of them) for not respecting the rules of town planning.

In September 2020, the proposal to sell these lands by mutual agreement was first submitted to the municipal council. Nicole Ottavy, in charge of town planning, explained that this sale made it possible to regularize the prospect (fixing the minimum horizontal distance authorized between a building and the limit of a plot).

Faced with the outcry aroused in the ranks of the opposition for which the procedure amounted to granting “a bonus to the fraudster”, the mayor explained that he had decided “after consultation and in his heart of hearts”; it was appropriate that the file “posed a certain number of questions” while underlining the existence of several similar situations on the route des Sanguinaires.

Monday, while the outcome of the debates was in no doubt, that is to say the vote of the sale by the overwhelming municipal majority, the opposition once again had the opportunity to express its deep disagreement, through technical and moral arguments.

The first to carry out the attack, Jean-Paul Carrolaggi, from Aiacciu pà tutti, noted the differences between the areas initially offered for sale in September and those included in the last deliberations: “These were two plots of 900 m2 to allow the regularization of gold prospects, today, in the deed of sale which is missing documents, the sale is reduced to 232 and 668 m2 (…). And you do not tell us what you will do with the rest of the land that you had leased at 30 euro cents per m2 – many Ajaccians would like to be able to benefit from land at these prices … ”.

And the chosen one to embark on a comparison of the price of Ajaccian land: “I took a tour of Leboncoin, I found land at Confina at 500 euros per m.2, at 250 euros in Alzo di Leva. Route des Sanguinaires, the town sells 290 euros per m2. The Amhan brothers are thus making a very good real estate business to the detriment of the municipality for which we have just voted a constrained budget. I would like to know why ”.

Sole representative of the left, Étienne Bastelica will vote against these deliberations: “If it were for 600 euros per m2 and supplement the budget for social works in the municipality, why not. But there, we say to ourselves that it is ultimately depending on whether you are powerful or miserable. And what will be our response to others who will also want regularization? “

In the ranks of Pà Aiacciu, Jean-François Casalta retraces for his part a meticulous history of modification permit requests filed in 2014, for strong increases in living space. It recalls the strongly negative opinion of the architect of the buildings of France; cites the decision of the Bastia Court of Appeal of September 19, 2018 in which are reported the arguments of the owners who “neither, at first instance, nor on appeal, contested the principle of their guilt, but recognized that they had ‘tried it’ ”.

The elected continues: “All the lights were red, (…) and you, what did you do, Mr. Mayor? You have opted for the most unpleasant method in the matter, namely the non-response to these requests for amending permits, which is equivalent to a positive response by the technique of tacit permission (…) a technique well known for mayors who don’t want to get wet ”.

“Don’t be the mayor who regulates this type of situation! “

The elected representative still quotes the magistrates of the Bastia Court of Appeal when they evoke “a series of gross errors of the town planning services in the processing of the request for amending permits which do not fail to surprise with regard to such constructions in a prestigious site of this city ”.

Recalling that the mayor is “not in charge of the execution of the court of appeal which decided on the rehabilitation”, Jean-François Casalta underlines that “it is not a question of a modest family who had his main residence built and who in good faith failed to respect the town-planning rules, in which case we would be sensitive to it (…) but these are notables who have violated in extraordinary proportions the rules of right in a site which is one of the most beautiful in our territory (…) and which is also preparing to make a considerable profit since (…) in October 2014, the announcement relating to the sale of one of the houses being finished was priced at 1,650,000 euros ”.

In conclusion, the elected PNC noted the lack of presentation of several documents in the deliberation and warned that the “violation of legal requirements in the matter, will very likely taint the legality of this deliberation”.

Nicole Ottavy opposes another history: “These two constructions were the subject of a first work order signed when I was appointed to this post and which we sent to the prosecutor, so we are at the genesis of this case. illegal construction. The assistant insists that the sale will “not clear customs for the rehabilitation of what does not comply with the building permit, and will only regularize their prospect.”

For Aiacciu pà tutti, Jean-André Miniconi relies on the immoral nature of these sales: “We are in the midst of real estate speculation that we can no longer contain and we have the typical case of two people who wanted to speculate. (…) We are in an area exceeding 1,600 m2, it’s almost a mini-market, there is a very important moral aspect, I say it from the bottom of my heart, do not be the mayor who tries to regularize this type of situation. “

Laurent Marcangeli, who patiently let the opposition unwind the torrent of criticism, responds concisely. Emphasizing the transparency in which his team has worked, he declares his intention to go “to the end of this process”: “It could be contested other than by a debate in the municipal council (…) I am trying for my part to do things as I see fit, taking advice beforehand, then I decide and I submit to deliberation of the municipal council. We will see where it all takes us (…) ”

Taking care to emphasize that the two owners are not “close friends”, the mayor concludes: “There is a simple principle, it is that of legality, if it is not respected, the decision that we take will be retoked. As for the moral judgment, I leave you, if you wish to become it, judge of the morality of the ones and the others. As far as I am concerned, I will not go on this ground, I leave that to professionals who have taken an oath to dispense justice and therefore make judgments ”.
