It was far from 105 votes. After the withdrawal of the third man, Serge Van der Hoeven, the duel between David Bustin and Franck Agah promised to be tight. But it was ultimately the first that won on June 28.
From the evening of the second round, the leader of the “Vieux Condé Ô cœur” list announced his intention to file an appeal to cancel the ballot. A request which has just been rejected by the administrative court.
Racism and illegal proxies
Among the elements that may have had an impact on the election, Franck Agah retained “A racist text message (which) had been sent to her on her phone” which had earned him to file a complaint.
He also denounced irregularities concerning the powers of attorney, and the fact that the municipality had “Organized a home gift delivery for couples celebrating their golden wedding anniversary to broaden the scope of people to whom it was proposed to carry out a power of attorney. “
Charges dismissed
In its report, the administrative tribunal sweeps away the grievances filed by Franck Agah. The 3rd chamber thus explains that it could not be proved in one way or another that the message of a racist nature “Would have been sent by a candidate for the elections, nor that it would have been the subject of public dissemination”.
Regarding the six proxies retained by the candidate, she found no irregularity likely to cancel the ballot. David Bustin is therefore reinforced in his first mandate as mayor of Vieux Condé.
