Vienna University of Economics and Business Wins Austria-wide Law Competition

A team from the Vienna University of Economics and Business prevailed in the competition between the law faculties for authentic disputes.

For the 20th anniversary of the Austria-wide civil law moot court, the Alpen-Adria-Universität Klagenfurt completed the group of participating universities offering law studies with a team of students. This time, however, the regular participant WU Vienna won: Nikolaus Hofmann, Mona Nebauer and Maria Simiuc, who had been looked after by Liebenwein Rechtsanwälte, prevailed in the final in Graz against a team from the University of Graz.

The President of the Supreme Court, Elisabeth Lovrek, chaired the mock dispute about authentic, merely anonymous cases from the case law of the Supreme Court. Also in the Senate were Bettina Nunner-Krautgasser, professor of civil procedure law at the University of Graz, and her faculty colleague, lawyer Gernot Murko, professor at the Institute for Corporate Law and International Business Law.

The final case dealt with a circumvention deal concluded around 40 years ago, which was intended to provide a German citizen with a leisure residence in Tyrol. The “buyer” at the time wanted the purchase price back in the process, which raised questions about the statute of limitations, a possible acknowledgment and the security of a non-existent loan claim. So there is enough material to spread comprehensive knowledge of civil law.
