The Institute for the Assistance and Attention to the Victim of Crime, an entity subject to investigations by the Public Ministry and directed by the former deputy of the canceled Patriot Party, Alejandra Carrillo, has appointed part of its legal staff to attend to personal cases of the official public, who with state funds are paid salaries.
These are the lawyers José Alfredo Olazábal Mendizábal and Hugo Leonel Marroquín Carrera, both hired by the Victim Institute for the area of ”Legal Advice” under lines 022 and 029 respectively, according to public information documents from the Victim Institute. The two workers have been assigned tasks related to legal cases in which Alejandra Carrillo, general director of the institution, is involved.
ASSIGNMENT: CASE OF CORRUPTION INVESTIGATED BY THE MP
According to the employee directory and the 022 and 011 salary and salary forms of the Victim Institute found in Public Information of its official website, José Alfredo Olazábal Mendizábal occupies the position of Legal Advisor I, for Q20,666.24 monthly.
Sources familiar with this situation, who requested anonymity for fear of reprisals, told La Hora that in June the general director of the Victim’s Institute, Alejandra Carrillo, instructed Olazábal Mendizábal to “procure” a copy of the file of one of the corruption cases for which the institution is investigated and in which the Director was a person of interest.
“In accordance with literal I) of the Third Clause of the Individual Administrative Contract for Work Under Line Zero Twenty-two Number One Hundred Twenty-two Script Two Thousand Twenty One, it is delegated as a function to seek to obtain a copy of the Fiscal file identified as -MP- zero zero one script two thousand twenty-one script eighteen thousand seven hundred fifty-two (MP001-2021-18752) of the Prosecutor’s Office Against Corruption, with the purpose of requesting copies and thus collaborating and assisting in the investigation ”, says the notification that was given to him to the lawyer.
“From the foregoing, you must report the result of the completion of the request for the related file to this General Directorate” adds the official letter signed by the general director of the Victim Institute, Alejandra Carrillo.
According to the sources, the file to which Carrillo wanted to have access is related to the investigation of a possible overvaluation of the lease of the building where the Victim Institute operates, in zone 10 of the capital.
The Prosecutor’s Office against Corruption investigates a possible overvaluation of the lease and payment of “bite” around the building where the entity’s headquarters are located, in which it is presumed that Carrillo would benefit from part of the rent payment.
THE FISCAL IS TRANSFERRED
On July 10, the attorney general, María Consuelo Porras Argueta transferred the auxiliary prosecutor Eduardo Pantaleón from the unit, who was in charge of investigations for possible acts of corruption within the Institute of the Victim, one of these related to alleged 109 ghost places .
Pantaleón went from the Office of the Prosecutor against Corruption to the Liquidating Office of the MP. His change was made two weeks after they revealed investigations at the Victim’s Institute, directed by Carrillo.
The MP justified that the change of Pantaleón was made to protect his life and minimize the level of risk, but they did not explain the danger he was running from being in said prosecutor’s office. However, La Hora learned that this was due to the investigations carried out at the Victim’s Institute.
ASSIGNMENT: COMPLAINT AGAINST HOUR OFFICERS
Hugo Leonel Marroquín Carrera was hired by the Victim Institute for Q66,774.19, for the period August to December 2021, it appears in the Publication Number Guatecompras (NPG) E491752547 of the Information System of Contracts and Acquisitions of the State, Guatecompras.
Marroquín Carrera’s contract indicates that his professional services are for the “Legal Counsel” of the General Directorate of the Victim Institute, a position held by Alejandra Carrillo. His hiring was “for the best performance of the provision of services,” he adds.
The lawyer Marroquín Carrera was appointed as Carrillo’s representative in a hearing requesting security measures against executives of La Hora, held in the Criminal Court of Femicide and other Forms of Violence Against Women and Violence. The general director of the Victim Institute, Alejandra Carrillo, filed a complaint against the general director of La Hora, Oscar Clemente Marroquín and the director, Pedro Pablo Marroquín for journalistic publications related to his public function, which according to the public official, “They are an attack on her dignity, against morals and good repute”, for which, protected by the Law Against Femicide and Other Forms of Violence against Women, she requested security measures. The Public Ministry joined in this case.
LAWYER BACKGROUND
The Guatemalan Government News Agency (AGN) published in April 2018, the swearing in of José Alfredo Olazábal Mendizábal as Vice Minister of Antinarcotics of the Ministry of the Interior.
“After swearing in office, the official assured that the main instruction issued by the president of Guatemala, Jimmy Morales, is to continue the fight against the scourge of narcotics in the country,” the publication stated.
In November 2020, the Special Prosecutor’s Office against Impunity filed an accusation in the abbreviated procedure against Hugo Leonel Marroquín Carrera, who recognized the facts for which he was linked to the process of the Fénix case for the crimes of concealment and breach of duties .
Investigations by FECI and the then International Commission Against Impunity in Guatemala (CICIG) indicate that, implicated in the Fénix Case, such as Gustavo Adolfo Herrera Castillo, they created a structure in order to launder money taken from health program funds of the Guatemalan Social Security Institute (IGSS).
However, in June the Second Higher Risk Chamber annulled the criminal proceeding against 52 defendants in the Fénix Case, which was in charge of the Higher Risk Court “D”, of Judge Erika Aifán; on that occasion the FECI announced that they would seek to revoke that ruling.
INSTITUTE BUDGET
The Victim Institute began its functions in 2020, despite the fact that the law for its creation was approved in 2016. It began work with a Q10 million budget, but increased it to Q50 million, after a budget expansion approved by Congress within the framework of attention to the Covid-19 pandemic.
Currently they continue with a Q50 million budget and it is intended that next year they will approve the same amount.
