Verkhovna Rada Committee Recognizes Government Bill on Mobilization Containing Corruption Risks

The Verkhovna Rada Committee on Anti-Corruption Policy at a meeting on Monday recognized the government bill on mobilization as containing corruption risks.

Details: According to her, the committee came to the conclusion that mobilization is needed in Ukraine, but some provisions of the relevant bill have corruption risks. Radina did not specify which ones exactly and promised to provide this information later.

She added that representatives of the Ministry of Defense and the General Staff of the Armed Forces of Ukraine were present at the meeting. They agreed with the committee’s conclusion and promised to correct the shortcomings.

Direct speech: “The committee actually discovered a number of problematic norms that could lead to corruption risks. At the same time, the Ministry of Defense agreed with the comments made. Together with the relevant committee, the committee on the health of the nation and other colleagues, we are already working on changing procedures and approaches.”

Details: Radina noted that the committee’s decision does not mean that its members are against improving the mobilization procedure. On the contrary, “mobilization must be fair, predictable – and without corruption holes.”

The chairperson of the committee listed what needs to be improved in the bill in order to avoid corruption risks:

  • Do not impose on local governments the responsibility for ensuring the arrival of those liable for military service at the TCC. Local authorities can provide transport, but cannot use coercion. After all, the obligation to ensure arrival without specifying the way this should happen can give rise to arbitrariness.
  • Clearly define in what timeframes and under what conditions the TCC can initiate the inclusion of persons liable for military service in the register of debtors with subsequent restrictions on the disposal of property and the like. The head of the TCC should not have the opportunity to add people to the register the next day after their non-arrival (after all, non-arrival is possible for good reasons), and “not notice” someone for months. Restriction of rights may occur after a person is held accountable for violating the obligation to appear when called.
  • Remove the right of district (city) commissions on issues of assignment for military service, as well as higher-level commissions, at their discretion, to grant citizens deferments from assignment to basic military service (not to be confused with mobilization).
  • Direct speech: “There are significantly more issues in the bill that require careful refinement. First of all, to overcome corruption in the Military Medical Commission (military medical commission) and MSEC (medical and social expert commission). The procedures for confirming other circumstances that are grounds for deferment from mobilization.”

    Details: Radina promised that the detailed conclusion of the anti-corruption examination for the mobilization bill will be published on the Verkhovna Rada website.

    She also reported that from February to September 2023, the anti-corruption committee adopted 34 conclusions about the presence of corruption risks in various bills.

    Background:

    • On December 25, it became known that the Cabinet of Ministers submitted to the Verkhovna Rada a bill “On amendments to certain legislative acts of Ukraine regarding the improvement of certain issues of mobilization, military registration and military service” No. 10378, which regulates issues of deferment from conscription for military service, in including people with disabilities.
    • The government proposes that parliamentarians impose a number of restrictions on those citizens who have not fulfilled the obligations of mobilization preparation and mobilization, increase fines for violators of military registration rules and defense legislation, and imprisonment for refusal to undergo a medical examination in the same way as for evading mobilization.
    • Verkhovna Rada Commissioner for Human Rights Dmitry Lubinets said that some provisions of the draft law on mobilization may contradict the Constitution.
    • Advisor to the head of the President’s Office, Mikhail Podolyak, said during the telethon that the bill on mobilization will be put to a vote in the Verkhovna Rada only after discussion and amendments are made.
