Albornoz, a Venezuelan national, was one of eight illegal immigrants arrested for weapons and drug offenses in the Bronx on March 27, ICE officials said. He was convicted in Bronx County Superior Court of criminal possession of a firearm.
According to a press release, Albornoz was met by the US Border Patrol near El Paso, Texas on September 22, 2022. He was released to the United States because the El Paso Detention Center was unable to hold him.

His first encounter with law enforcement occurred on June 18, 2023, when Moonachie police arrested Albornoz for shoplifting. Teterboro Municipal Court sent the charges against Albornoz to a lower court and released him three days later.
On January 6, 2024, Albornoz was arrested again by the Woodbridge, New Jersey Police Department for shoplifting and making burglary tools. ICE’s Enforcement and Removal Operations (ERO) issued an immigration warrant for Albornoz on January 8, but local authorities in North Brunswick ignored the detainer and released him without informing the ERO, officials said.

Albornoz was arrested again by the New York Police Department on March 27, this time for second-degree criminal possession of a weapon: a loaded firearm; second-degree loading of a firearm on school grounds; criminal possession of a controlled substance with intent to sell; and to act in a way that harms a child under the age of 17 years.
The ERO filed a second immigration hold for Albornoz with the New York Department of Corrections at Rikers Island on April 1, according to the news release.
Albornoz was convicted of criminal possession of a firearm on September 5 and sentenced to six months in prison. However, ICE said he was released again, despite being actively detained, without notifying the ERO.
A few weeks later, on September 27, an FBI task force alerted the New York ERO of possible threats Albornoz allegedly made toward local law enforcement and asked for help to to find and ‘Stop. He was taken into custody by ICE the next day.

Genalo chastised New York City and state leaders for their asylum policies and urged them to allow local law enforcement to cooperate with ICE in deporting criminal aliens.
“Fortunately, thanks to the due diligence of our courageous brokers and law enforcement partners, this individual was caught quickly and never had the opportunity to reoffend,” he said.
