Vanessa Youness, the girlfriend of former DGIPI head Gelu Oltean, sentenced to three years in prison for taking a bribe worth 1 million euros, was released from prison, pending judgment on the annulment appeal she filed.
The decision of the Bucharest Court of Appeal, delivered on October 14:
- “In the opinion of the majority: On the basis of art. 430 cpp, it accepts the request, made by the applicant Youness Amal Vanessa, to suspend the execution of the criminal sentence (…) orders the immediate release of the applicant-convicted Youness Amal Vanessa pursuant to article power of the warrant to execute the prison sentence. ”The decision is final.
Art. 430 provides:
- Until the appeal for annulment is resolved, the court seised, taking the conclusions of the public prosecutor, can suspend the execution of the decision which is being annulled.
At the end of May, Vanessa Amal Youness was sentenced to three years in prison with execution for dealing with fluin a case in which she was accused of having received € 1 million from a businessman to intervene with a Romanian government official in connection with the award of Microsoft licenses.
He filed an appeal for annulment on the basis of the CCR’s decision declaring an article of the Criminal Code unconstitutional that allowed prosecutors to break the statute of limitations by administering new evidence.
