Donald Trump cannot be removed from the presidential election ballot, the US Supreme Court ruled on Monday. That means one hurdle less in Trump’s chances of becoming a presidential candidate.
In December, the highest court of the state of Colorado ruled that Trump should not participate in the primaries in that state because of his role in the Capitol storming of January 6, 2021. Many see the former president as one of the instigators. The same conclusion was reached shortly afterwards in a few other states.
Trump appealed Colorado’s ruling to the Supreme Court. The highest U.S. court had to determine whether the state’s ruling was correct.
Colorado based the decision on a provision in its constitution. Part of the Fourteenth Amendment states that Americans who were involved in an “insurrection or rebellion” may no longer hold political office.
The court ruled on Monday that the state does not have control over that provision of law at all, but that it lies with Congress. That is why the court finds that the state made a mistake by removing Trump from the ballot.
Now that the Supreme Court has ruled that Trump can remain on the ballot, that is one hurdle less for the former president. The only thing that could stand in the way of his presidential candidacy are the criminal cases still pending against him. If he is convicted before the presidential elections in November, he will be banned from running again.
The US states of Maine and Illinois had also removed Trump from the ballot, but that decision was put on hold pending the Supreme Court’s ruling in the Colorado case.
