US border guards can cut or move barbed wire in the state of Texas near the border with Mexico, the US Supreme Court has ruled. The Court thus agrees with President Biden’s government, which had asked to be allowed to do this, while the state of Texas is wrong.
The White House and Texas have been arguing over the security of the US-Mexico border for some time. The Supreme Court’s ruling concerns a stretch of barbed wire stretched about 30 miles (46 kilometers) along the Rio Grande border river.
Five of the nine justices agreed to Biden’s request: three justices seen as liberal, along with Chief Justice John Roberts, known as a conservative, and Amy Coney Barrett.
Emergencies
The border guard, which is headed by the national government, has already been allowed to remove barbed wire in extreme emergencies (for example if someone is drowning). But due to rulings of lower courts, this was not allowed in any other case.
This would allow the Border Patrol to act on land owned by the state of Texas or by residents of Texas. The Supreme Court’s ruling gives the Border Patrol more room to cut or move barbed wire in certain places, making it easier to reach people in need.
According to the Republican governor of the state of Texas, Greg Abbott, President Biden’s administration is doing far too little to keep migrants out. Among other things, Abbott had a 300-meter-long barrier installed in the Rio Grande, consisting of a line with orange buoys. There is also a legal dispute about this between the state of Texas and the Biden administration.
