In the US, the state Supreme Court has ordered that all New York city employees who were fired because they were not vaccinated be reinstated and receive back pay.
The court found that “vaccination does not protect a person from contracting or transmitting COVID-19.”
New York City Mayor Eric Adams said earlier this year that his administration would not rehire employees who were fired for not being vaccinated.
The city of New York laid off around 1,700 employees at the beginning of the year because they were not vaccinated after the city introduced mandatory vaccinations under former Mayor Bill de Blasio. Many of those fired were police officers and firefighters. The Supreme Court also found that their rights had been violated.
The mayor had also approved an exception to the vaccination requirement for athletes and artists, while at the same time firefighters were still being fired because of their status. James McCarthy, president of the FDNY-Uniformed Fire Officers Association, said earlier this year:
“We are here to say that we support the lifting of the vaccination requirement that the mayor announced on Thursday. We believe it should also be extended. We support the revocation of the mandate for athletes and artists working in New York City. We believe the mandate should also shift to the people who work for New York City.”
The court therefore came to the conclusion:
“There is no evidence that it would be prudent to maintain a vaccination requirement for public sector employees while removing the requirement for private sector employees or creating an exemption for certain professions such as athletes and artists. This is clearly an arbitrary measure, as these are equally unvaccinated people who are being treated differently by the same administrative authority.”
