Montgomery, convicted in 2004 of strangling a pregnant woman in the state of Missouri, would be put to death on December 8. She is the only woman on federal death row. Her lawyers had asked for a postponement after becoming infected with the coronavirus when they flew back from a visit to Montgomery at the federal prison in Terre Haute, asking for more time for a pardon.
Justice then moved the execution to January 12. According to the lower court, a new date should not have been scheduled for January 1, but the judges of the court of appeal do not agree. Montgomery’s attorney wants to petition that ruling. She has also asked President Trump to commute her client’s death sentence to life without parole.
The last woman executed by the US government was Bonnie Heady, who was put to death in a gas chamber in Missouri in 1953.
