Mexico., August 14, 2021.- In a victory for the states of Missouri and Texas, which filed the lawsuit, United States District Court Judge Matthew Kacsmaryk said Friday that the Biden administration violated procedural laws by failing to consider “various of the main benefits ”of the program and acted“ arbitrarily and capriciously ”to put an end to it.
A memo from the Biden administration announcing a formal end to Donald Trump’s policy was published on June 1. It was unclear how the ruling would ultimately affect that decision. The former president instituted the policy in early 2019.
Trump-appointed Kacsmaryk suspended his decision for a week to allow the administration to appeal. The Department of Homeland Security (DHS) did not immediately respond to a request for comment.
Trump’s policy of “staying in Mexico”, officially known as the Migrant Protection Protocols (MPP), sought to block the advance of asylum seekers from Central America by making them wait in Mexico for the outcome of their hearings in the United States.
Defenders of immigration policy said it reduced pressure on immigration officials, while human rights groups said it violated due process and exposed homeless refugees to the risk of crimes such as kidnapping, abuse and rape.
