Uruguay’s Organ Donation Law and Presumed Consent System: Facts and Numbers

In Uruguay, according to Law 18,968, which entered into force in September 2013, it is established that all Uruguayans over 18 years of age are organ donors unless they express their will to the contrary. The director of the National Institute of Donation and Transplantation (INDT), Milka Bengochea, indicated that those who do not express a contrary will, before the law will be donors.

This law establishes something called “presumed consent”, where the living person, if he does not mobilize to indicate the contrary will to the donation, it can be presumed that he has nothing against it and is considered a donor.

This procedure consists of completing a document in person, with the aim of expressing the willingness of positive donation (partial or total) of organs and tissues, or the will not to donate.
