Update on Eyemaxx Bonds: Joint Representative Provides Interim Status and Possible Contestation of Austrian Securities

One Square Advisory, as the joint representative of the three unsecured bonds from Eyemaxx, provided information on the new interim status in the morning.

In the last creditor information, OSA had about the new representation of the secured bondholders (bond 2020/25) and about the conceivable possibility of contesting the ordered Austrian securities informed.

In a vote without a meeting in March 2022 RA Meyer in Schwabedissen the law firm mzs Rechtsanwälte, elected as the new common representative of the secured bond 2020/25.

Meyer zu Schwabedissen, in his function as joint representative of the bondholders 2020/25, initially had attorney Dr. Christoph Stapf, Vienna, with the clarification on question on the lawful provision of the collateral for the bond. In September 2022, for reasons that were not specified, Meyer zu Schwabedissen hired RA Dr. Stefan Kofler, Innsbruck, commissioned as new expert.

So far, only an oral agreement regarding dthe proceeds from the sale of the Graz/Grabenstrasse property accruing to the bondholders be achieved. It was agreed that one common trustee is ordered, the bondholders consent to the deletion of the mortgage registered on this property and distribution is clarified in court proceedings.

The judicial clarification of the question of the legal validity of the Ordering real estate mortgages could himself through several instances and thus up to the final decision over many years. One Square is therefore trying to answer this question to find an amicable solutionbecause otherwise the distribution of the proceeds from the sale would be delayed by many years.
